Governor Hochul holds a bachelor’s degree from Syracuse University and a JD from Catholic University in Washington, DC. At the start of her legal career, she worked at a large firm in Washington and later as in-house counsel to a major corporation engaged in homeland security. Hochul then gave up private practice for public service. She was asked to serve as a legal counsel and legislative assistant to Congressman John LaFalce (D-NY) and later to Senator Daniel Patrick Moynihan.<br />

<span style="font-family: Times, Times New Roman, serif;">The allegations contained in the federal lawsuit include the ultimate firing of an employee, a Mr. Pignone, who was apparently seeking to secure a better compensation package for village employees. But then rumors, alleged to have been started by John Pierpont, circulated saying that the employee was only looking out for himself. The self-serving stories, of course, angered the other employees, and that's when the "...campaign of harassing conduct..." began in the small suburban village of Pelham Manor government. </span><br />

New York's Office of Court Administration ("OCA") refers to the $2 Billion dollar hot-air presentation as a "road to recovery" budget. The jumbled collection of vague numbers and words fills nearly 200 pages, and would surely be sufficient grounds to fire any accounting professional who would dare present such a "budget."</div>

The renovation of OCA's 30,000-square-foot Romanesque Revival landmark hotel-for-judges, a former convent, has been another waste, funded by creatively hidden budget entries. Gross mismanagement aside, OCA treats human beings like garbage. To be fair, however, New York's Court Administrative machine mistreats everyone equally:</div>

<b><u>Judges</u>:</b> here's a thankless group. Every judge is slapped with the reality that every decision he or she makes results in having made one temporary friend, and one permanent enemy. More outrageous is the fact that the court system was unable to give judges a raise for 13 years. And when they did get an insult of a raise, it was structured to be phased in over 3 years. <b><u>Court Employees</u>: </b> OCA made believe they were saving big dollars by cutting overtime for employees dependent on the extra income, but court administrators forget to mention that millions of dollars were spent on renovating luxurious office suites for favored administrative court bigwigs. There are a lot of court employees who have much to say about their decrease in pay, denial of over-time pay, and generally how mismanaged the entire court system is run. (<u>See</u>, <b><i>Shaw v. In addition, countless federal lawsuits have been filed against OCA regarding rampant corruption and the wide-spread practice of retaliation against anyone and everyone. It's the way the court system is operated in New York State.</div>

One such lawsuit is <i>Corrado v. New York State Unified Court System</i>, filed in the federal court in Brooklyn (EDNY # 12-1748) (<u>See</u>, <a href="http://www.justiceinourcourts.com/">www.JusticeInOurCourts.com</a>) After this state-employed ethics attorney was sexually harassed, OCA went into hyper-retaliation mode <b><i>against the victim</i></b>! Governor Cuomo has personal knowledge of this atrocity, and the federal court filing.</div>

Many years ago, a governor called Mario Cuomo was brave enough to support a Presiding Judge in Manhattan who was determined to confront the corruption within OCA's so-called attorney "ethics" department. The presiding judge, Francis T. Murphy, took NYC corruption on- <b>full force-</b> he was determined to clean house. <span class="fullpost" style="background-color: white; display: inline;">A state Supreme Court jury has determined that a U.S. magistrate judge punched a Jamesville woman in August 2006 on Grindstone Island, but awarded no damages to the victim. The jury deliberated for less than an hour Wednesday before reaching a verdict that Lisa Margaret Smith committed battery against Julie L. Purcell on Aug. 20, 2006. The jury subsequently pronounced Mrs. Purcell was entitled to no damages for the act. "It was never about providing damages," said Stephen W. Gebo, Watertown, Mrs. Purcell's attorney. "It was particularly a vindication that she was the victim of a battery. The jury said she was, and we're pleased with that.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">Mrs. Purcell sued Ms. Smith in October 2006, claiming she was "sucker-punched" in the face at a gathering at a campfire. Mrs. Purcell was attempting to obtain more information about an incident the night before in which her two daughters and a friend had their clothes stolen and one of the girls was allegedly assaulted after skinny-dipping at Potter's Beach. Mrs. Purcell said she believed the judge's nephew might be able to identify some of the alleged assailants. Taking the witness stand Wednesday, Judge Smith, a chief U.S. magistrate judge for the U.S. District Court for the Southern District of New York, White Plains, vehemently denied she punched or kicked Mrs. Purcell.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">Judge Smith testified that she was temporarily blinded by the campfire as she approached Mrs. Purcell to ask her to stop "ranting" and using "vile" language in the presence of the judge's children and other children. Because she couldn't see, she had her hand in front of her as she walked. "I took two small steps, and I came into contact with something. I touched something," Judge Smith said. She said Mrs. Purcell immediately began screaming, "She hit me," an allegation the judge denied.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">"I did not touch her intentionally. I did not touch her maliciously," Judge Smith said. "I've certainly never punched anyone or hit anyone. I've never hit anyone. I don't even know how to punch someone." When asked by her attorney, Kevin E. Hulslander, why she immediately left the area while Mrs. Purcell was screaming that she had been hit, the judge said she knew it would be of no use to try to talk Mrs. Purcell about the incident. "I felt as though she had painted a target on my forehead and I knew that I was going to be in this courtroom, that she was going to sue me," Judge Smith testified. Mr. Hulslander said in his closing statement that the judge had been provoked by the "vile, nasty" language coming from Mrs. Purcell and that the judge was "standing up and taking a stand" on behalf of her children. He called Mrs. Purcell's lawsuit "revenge" for her belief she had been purposely punched, contending that Mrs. Purcell "exaggerated" the incident and her purported injuries. "Why are we here?" he asked the jurors. "Damages? Pain and suffering? This case? No. We're here because this woman here, Mrs. Purcell, wants retribution. She wants to bring a judge down."</span><br />

<span class="fullpost" style="background-color: white; display: inline;">Mr. Gebo argued in his closing statement that Judge Smith "abused her position" by identifying herself as a judge before approaching Mrs. Purcell in an attempt to "intimidate" her. "I submit to you that punching Julie as hard as she could, when she wasn't looking, was malicious," Mr. Gebo told jurors. "This is an opportunity to say the law applies to every one of us, even a United States magistrate judge." The incident at Potter's Beach that led to the confrontation between the women is the subject of a separate lawsuit pending in state Supreme Court. <span class="fullpost" style="background-color: white; display: inline;">Testimony began Monday in state Supreme Court in the civil trial of a U.S. magistrate judge who allegedly assaulted an attorney's wife during a dispute over a skinny-dipping outing on Grindstone Island. Lisa Margaret Smith, a chief U.S. magistrate judge for the U.S. District Court for the Southern District of New York, White Plains, was sued in October 2006 by Julie L. Purcell, James-ville, who claimed the judge "sucker punched" her in the face in August 2006. Kevin E. Hulslander, Syracuse, Judge Smith's attorney, argued in his opening statement that his client was provoked by "an explosion of expletives" from Mrs. Purcell in the presence of several children, including those of Judge Smith. "There's no doubt there was contact," Mr. Hulslander said. "There may have been a slap. The intent is what's at issue." According to court documents, the two women were discussing an incident that occurred the previous night in which two of Mrs. Purcell's daughters and a third teenager had their clothes stolen while swimming nude off Potter's Beach. One of the girls was allegedly assaulted as the teenagers tried to retrieve their clothes. The next night, Mrs. Purcell was discussing the incident around a campfire, with Mrs. Purcell claiming the judge's nephew had witnessed the incident at Potter's Beach and could identify some of the alleged assailants.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">Judge Smith denied the youth saw anything, prompting Mrs. Purcell to call her "a goddamned lying bitch," and asking her, "Why the cover-up?" according to Mrs. Purcell's testimony Monday. She said she heard "shuffling" coming from the area where Judge Smith was sitting and then "I was punched, full force, in the right cheek." She also claimed the judge kicked or kneed her. "She said, 'You're not going to call me a goddamned lying bitch. I'm a U.S. magistrate judge,'" Mrs. Purcell testified. Mr. Hulslander told the jury that Mrs. Purcell's outburst went beyond a single curse, stating that she directed numerous expletives at Judge Smith "around a campfire with children roasting marshmallows." "Judge Smith spoke up, said, 'I'm a judge, please don't swear in front of my children,'" Mr. Hulslander said.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">He contended that the statement initiated another round of expletives from Mrs. Purcell in which Mrs. Purcell indicated her indifference to Judge Smith's position. Judge Smith was charged by state police with second-degree harassment as a result of the incident. She later was granted a six-month adjournment in contemplation of dismissal and the charge was dismissed. Mrs. Purcell's attorney, Stephen W. Gebo, Watertown, denied his client swore multiple times, portraying her to the jury in his opening statement as an upset mother trying to find out more about her daughters' attack by "a mob" of eight people. Mrs. Purcell testified that she experienced pain in her cheek and around her eye for several months, although she suffered no permanent physical effect from the alleged punch. However, she said she remains "nervous" at times in public and the family has put its Grindstone Island property up for sale "because I don't feel comfortable there." She said she also had to leave her job as a grand jury court reporter. "I couldn't do that job any longer because I would start crying when I would hear these cases," she said. Her lawsuit seeks an unspecified amount in damages for the alleged effects the punch has had on her, as well as punitive damages. Testimony in the trial is scheduled to resume this morning.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">A state Supreme Court judge has ruled neither the plaintiff nor the defendant should be awarded costs in a civil case in which both sides, arguably, won. Typically in a civil case, the side that prevails is entitled to recover costs incurred in the action, excluding attorneys' fees. But what happens when it cannot be said with certainty which side won or lost? Judge Joseph D. McGuire has ruled that, under these circumstances, "it would be inequitable to award costs to either party." The issue arose when a Supreme Court jury in Watertown ruled in December that Lisa Margaret Smith committed battery against Julie L. Purcell, but awarded no damages to Mrs. Purcell. Mrs. Purcell, Jamesville, had sued Ms. Smith, South Salem, in October 2006, claiming she was "sucker-punched" in the face by Ms. Smith at a gathering around a campfire on Aug. 20, 2006. Mrs. Purcell was attempting to obtain more information about an incident the night before in which her two daughters and a friend had their clothes stolen and one of the girls was allegedly assaulted after skinny-dipping off Grindstone Island. Ms. Smith said Mrs. Purcell was "ranting" and using "vile" language around her children and other children and she asked her to stop. She testified that as she walked toward Mrs. Purcell, she was temporarily blinded by the campfire. She said because she could not see, she had her hand raised out in front of her as she neared Mrs. Purcell and that her hand "came into contact with something," which Mrs. Purcell and others testified was Mrs. Purcell's face.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">A jury deliberated about 35 minutes before determining that Ms. Smith had committed battery, but awarded no monetary damage to Mrs. Purcell because she had not demonstrated that any pain or suffering resulted from the act. Ms. Smith, contending damages were an essential element of battery and their absence meant she won the case, filed a judgment Jan. 9 at the Jefferson County clerk's office against Mrs. Purcell for $1,095, representing her costs and disbursements in defending the case. The costs do not include attorneys' fees. According to an affidavit filed Monday at the clerk's office by her attorney, Kevin E. Hulsander, Syracuse, Ms. Smith "had to pay our firm tens of thousands of dollars to defend the case." Mrs. Purcell countered that she, not Ms. Smith, won the case and argued that she was the one entitled to costs because the jury had found that Ms. Smith committed battery. Mrs. Purcell applied to the court for an order vacating Ms. Smith's judgment.</span><br />

<span class="fullpost" style="background-color: white; display: inline;">Judge McGuire ruled that an award of zero damages did not entitle Ms. Smith to costs or disbursements "when there has been a companion finding in (Mrs. Purcell's) favor arising out of the same facts." "In this case, both parties were successfully asserting their rights, although it cannot be said that there was complete success by either," Judge McGuire wrote in his decision. He granted Mrs. Purcell's motion to vacate Ms. Smith's judgment awarding her costs, but also denied a motion by Mrs. Purcell to have costs awarded in her favor. Judge McGuire's decision on the matter has been accepted for publication with the state Law Reporting Bureau, which serves as a legal reference for jurists and attorneys facing similar cases. The allegations include: judicial steering, corruption, denial of due process and obstruction of justice.<br /><br /><span class="Apple-style-span" style="font-weight: bold;">History Repeats Itself</span><br /><br />Surrogate Scarpino, who handled the Harry Winston estate and is currently hearing the Brooke Astor estate, refused to remove himself from the Tom Carvel estate proceeding when it was found that he had loans from one of the parties. Also, it was reported that for over 4 years attorney Frank Streng advertised on the internet, and his law firm website, the fact that he was on Surrogate Scarpino’s election transition committee- a fact that angered many as Streng and McCarthy Fingar implied he had an "in" with the court.<br /><br />Mr. Streng, in various capacities, has also been involved in the Astor and Carvel estates. And as reported in the New York Law Journal last year, allegations of judicial steering are nothing new to the Westchester County courts under Administrative Judge Nicolai. That brouhaha resulted in a large court organizational shake-up in Westchester.<br /><br />The underlying matter, The Estate of Margaret A. McKeown, lingered in the Westchester courts since 2003, and the related 9/11 Red Cross donation fraud was subject of an April 28, 2006 article in The New York Times article, though the judges' names nor the allegations against them were not mentioned.<br /><br /><span class="Apple-style-span" style="font-weight: bold;">Better Late Than Never</span><br /><br />And though the alleged fraudulent assignment was filed in November of 2003, it would take until <span class="Apple-style-span" style="font-weight: bold;">July of 2007</span> for the Westchester County Surrogate's Court Chief Clerk, Charles T. Scott, to “locate” the assignment papers and place them in the court’s estate case file. Oddly, and also in July of 2007, Chief Clerk Scott advised in writing that he had corrected the three and one-half year “administrative oversight” by "back-dating" the filing date in the court’s computer. Surrogate Court court attorney Joseph M. Accetta, and who has close ties to Streng and McCarthy Fingar, has been recently implicated in the cover-up.<br /><div>

Streng, who at all times relevant was</a> <u><a href="http://picasaweb.google.com/CorruptCourts/JudicialAdvertising#" style="color: purple; text-decoration: none;">simultaneously</a></u><a href="http://picasaweb.google.com/CorruptCourts/JudicialAdvertising#" style="color: purple; text-decoration: none;"> advertising his (Streng’s) implied favoritism with the Surrogate Court on his McCarthy Fingar LLP law firm website, and on the internet.</a> Specifically, attorney Frank W. Streng was advertising the fact that he (Mr. Streng) had served on Surrogate Scarpino’s Election Transition Committee. In addition, The Justices were aware at all times relevant through court filings and correspondence that allegations were made that Mr. Streng drafted, executed and filed a fraudulent assignment of an approximate $200,000.00 estate related asset concerning a pending claim over $100,000.00 in stolen Red Cross 9/11 donation monies. Also, The Justices were knowledgeable that the “assignment” was executed by an impaired person who had been ordered by a criminal court judge to in-patient and out-patient care and who, in fact, committed suicide shortly after the purported “assignment” was executed (See attached <i>New York Times</i> Article)<o:p></o:p></div>

5.1 <b>All Times Relevant- </b>The Justices were aware that attorney Streng had served on the Surrogate’s Election Transition Committee when the Court considered and subsequently granted monetary sanctions to Mr. Streng on June 8, <b><u>2004</u></b> and on June 1, <b><u>2005</u></b>. It is notable that from at least early 2004, Surrogate Scarpino continuously failed to present for remittal, or to disqualify or recuse himself while he was considering the thereto related filings and issues which resulted in the June 8, 2004 and June 1, 2005 decisions.</div>

5.4 <b>All Times Relevant- </b>The Justices denied all requests to address the “fraudulent assignment” prepared, executed and filed by the same person who was advertising his implied favoritism with the court on the internet, Mr. Streng. In fact, Judge Scarpino denied <i>without prejudice to renew , </i>indicating that the issue could be raised at a future time in the estate accounting phase. But in that very same ruling Judge Scarpino imposed a motion prohibition. And acting-surrogate Loehr immediately imposed a total ban of any motions at his first hearing. Notably, Judges Scarpino and Loehr knowingly and purposely avoided ruling on the fraudulent assignment prepared by their close political associate Frank Streng.</div>

5.5 <b>April 7, 2005- </b>Judge Scarpino again chose to ignore his duty to remit, disqualify or recuse himself on his own initiative when he signed an April 7, 2005 Order to Show Cause, which sought to have Mr. Streng and his law firm disqualified for advertising its implied favoritism with the Court, wherein documents were presented showing that Mr. Streng was in fact <b><i>actively</i></b> advertising on his law firm website and on the internet the fact that he was a “[m]ember, Transition Committee of Anthony A. Scarpino, Jr., Surrogate of Westchester County (2001)” Notably, and as also presented in the April 7, 2005 OSC, one website posting listed, “serves on the Transition Committee of Anthony A. Scarpino, Jr., Surrogate of Westchester County (<b>March, 2001 – present</b>).” (emphasis added) Subsequently, and at all times relevant, Judges Nicolai and Loehr would also ignore their duty to remove themselves from any involvement in the proceedings.<o:p></o:p></div>

5.6 <b>June 3, 2005- </b>In his Decision and Order denying, <i>without prejudice to renew</i>, the disqualification of the McCarthy Fingar law firm and Mr. Streng, Surrogate Scarpino again ignored his own obligation to <i>sua sponte </i>disqualify or recuse himself, or to on his own initiative, present the matter for remittal. <b>Notably</b>, in the June 3, 2005 order, Judge Scarpino denies the requested relief <i>without prejudice to renew</i> (<i><u>See</u></i> attached June 3, 2005 Decision and Order, page 9)<o:p></o:p></div>

(<b>Note #1</b>: on the record in open court on August 3, 2005, Judge Scarpino specifically voiced that the case may <b><i><u>not</u></i></b> be transferred outside of Westchester County) (<i><u>See</u></i> Court Transcript of August 3, 2005 Surrogate Scarpino Recusal Hearing) (<b>Note #2:</b> Judge Scarpino recused himself from my Order to Show Cause which pointed to the Surrogate’s bias concerning attorney Frank W. There is clear bias here by Judge Scarpino to protect a member of his Election Transition Team by denying my right to due process, and by obstructing justice concerning fraudulent assignment inquiries.</span></i></div>

I had been mindful of Surrogate Scarpino’s now-confirmed prophetic statement during the August 3, 2005 hearing that the case may stay in Westchester County. 5.10 Judge Nicolai, I have since been informed, has had a long-standing political relationship with attorney Streng. And at all times relevant, Judge Nicolai failed his duty to avoid the appearance of impropriety. Subsequently, Judge Nicolai refused to transfer the matter outside Westchester County, choosing instead to assign the proceeding to the most junior county court judge, and longtime political associate, Justice Loehr.<o:p></o:p></div>

6.1 I believe The Justices have not only failed at all times during the estate proceedings to Avoid the Appearance of Impropriety by not presenting for remittal the known issues as presented herein, or by disqualifying or recusing themselves. But they collectively participated in a scheme to cover the misdeeds of their political friend, Mr. Streng. At no time did <b><i>any</i></b> of The Justices act in a way to assist in the $100,000.00-plus repayment of the stolen 9/11 donations. The Justices grossly failed their duty to insure judicial integrity and impartiality of court proceedings in the Westchester County Surrogate Court.</div>

Officials of the American Red Cross say they try to recover ''every last dollar'' lost to theft or fraud, but a Connecticut case involving the theft of $120,000 has raised questions about that commitment when it carries the risk of bad publicity. The Red Cross is under intense scrutiny over its response to Hurricane Katrina, including accusations of fraud and theft of relief supplies that volunteers say were ignored for months. In the Connecticut case, the Red Cross settled for less than half the money from its insurance company rather than pursue the full amount through litigation even though the agency was urged to do so by the suspect's brother. The brother, Kevin McKeown, said he was told by a local chapter official that pursuing the money would make the agency look bad. ''They were worried that any further publicity would create a scandal that would harm their fund-raising,'' Mr. McKeown said. National Red Cross officials now argue that a lawsuit would have been expensive and that success was far from certain. Volunteers and former Red Cross executives say the organization often places a higher priority on avoiding scandal than recovering stolen money, and a former president of the Red Cross, Dr. Bernadine Healy, offered support for that view. In an interview, Dr. Healy, who was pushed out after the terrorist attacks of Sept. 11, said the Red Cross board criticized her for firing the executive director of the Hudson County chapter in New Jersey, after she learned that he and the bookkeeper had embezzled almost $2 million from the organization. ''They told me I was too tough and too fast in firing the guy and moving in on this fraud,'' Dr. Healy said. ''I was told the way to handle these things was quietly and that nobody needed to know.'' Melissa Hurst, the Red Cross's assistant general counsel, disputed Dr. Healy's recollection. ''The Red Cross pursued that, and it was supported throughout the organization,'' Ms. Hurst said. The Connecticut case is full of legal twists and turns.<br />

The suspect in the case, Ronald P. McKeown Jr., was the executive director of the southeastern Connecticut chapter of the Red Cross from July 2001 until he resigned on March 1, 2002. Eight months later, he was charged with larceny, money laundering and forgery in connection with the embezzlement of more than $120,000 collected by his chapter for the families of victims of the Sept. 11 attacks. Almost a year after he was charged, however, Mr. McKeown committed suicide at age 52. His brother Kevin said his mother had been working on a plan to repay the Red Cross with her own money when she died in August 2003, leaving an estate of more than $1 million. ''We were hoping the repayment of the money would somehow lessen the criminal outcome of the charges,'' he said. The money to make good on that desire then became entangled in a fight over his mother's estate, and Ronald McKeown's death put it even further out of reach because he signed documents transferring his part of the inheritance to his recently remarried former wife.<br />

But Kevin McKeown contacted the Charter Oak chapter of the Red Cross in Connecticut, which had merged with the chapter his brother had run, and urged officials to try to regain the money Ronald McKeown was thought to have taken. The chapter's senior director of program services, Carla Burgess, told him that the Red Cross did not want any more publicity about the matter, he said. According to a copy of an e-mail message provided by Kevin McKeown and dated Oct. 8, 2004, Ms. Burgess said: ''Thank you for thinking of us. I also appreciate the fact that you seem to understand our position in choosing not to file a claim against the estate. I do wish you the very best in your efforts to honor your mother's wishes.'' Mr. McKeown said Ms. Burgess had misunderstood him. ''While I do understand their position -- they don't like bad publicity -- I have never and will never understand why they don't want their money back,'' he said. He said he was under no obligation to pay the Red Cross out of his part of his mother's estate. ''It was his responsibility, and now his estate has that responsibility,'' Mr. McKeown said. ''The only obligation and duty I feel is toward my mother's wishes.'' Ms. Hurst noted that the Red Cross had pursued prosecution of Ronald McKeown until he died. She said the organization had to consider the cost-effectiveness of various avenues of recourse. Mr. McKeown had not been convicted of theft before his death, and he had other financial difficulties related to collapse of a business he owned with another brother -- a chain of restaurants called Steak 'N' Egg -- both of which might have complicated recovery of the money. ''This individual committed suicide prior to going to trial,'' Ms. Hurst said. ''There was no judgment of guilt, no adjudication. We went through an evaluation of recourse and chose to file a claim with our insurance company.''<br />

On Tuesday, Mr. McKeown learned via an e-mail message from the insurance company that it had decided to try to recover from his brother's estate what it had paid out to the Red Cross. In recent months, critics of the Red Cross have questioned why it waited months to address accusations of theft and fraud in the New Orleans area after Hurricane Katrina, charges that have led to investigations by the F.B.I. and the Louisiana attorney general's office. ''From what I've witnessed and what I've been told, they don't go after everything they find,'' said Michael A. Wolters, one of the volunteers who made the accusations in a report he filed with the organization. Mr. Wolters said he was involved in uncovering fraud involving a police officer in Texas who obtained Red Cross debit cards and handed them out to law enforcement officials. ''He had access to just go get these cards and not even sign for them,'' Mr. Wolters said. ''Who knows how much he took? We turned over reports documenting about $400,000 that was missing.'' Ms. Hurst said the matter involved $360,000 and had been turned over to law enforcement officials.<br />

Kevin McKeown, an author and screenwriter, has refused to drop his argument with the Red Cross. In January, he told his story to members of the Senate Finance Committee and various high-ranking officials at Red Cross headquarters in Washington, but heard nothing until this month. On April 10, Mr. McKeown said, a lawyer from the national headquarters called him and said that the Red Cross had recovered from its insurance company 80 percent of the money his brother was accused of stealing. Mr. McKeown said the lawyer told him that the Red Cross considered the matter closed and that recovering the remainder of the money would be cost prohibitive. Mr. McKeown contacted the insurer, the Royal Insurance Company, which supplied records showing that, after a $50,000 deductible, it had paid the Red Cross $47,710.59 to cover his brother's theft, or roughly 40 percent of the original amount Devorah Goldburg, a spokeswoman for the Red Cross, said she could not confirm that Mr. McKeown had initially been given the 80 percent figure, but she said that on Thursday, April 20, in another conversation, the lawyer told Mr. McKeown about the deductible and the breakdown of what the organization recovered Mr. McKeown remains dissatisfied.''Thievery against the Red Cross is hardly discouraged when the crimes are underwritten by insurance companies and premiums are paid by unsuspecting donors,'' he said. ''I was shocked to learn this was how they handle things.'' </div>

As reported in the November 17, 2011 edition of the Westchester County Journal News, Officer Tillistrand was hit and seriously injured during a routine traffic stop on Boston Post Road in the small village of Pelham Manor. While the accident was widely reported, it took days before The Journal News uncovered that the driver of the vehicle that hit Officer Tillistrand was the daughter of the Village of Pelham Manor Fire Chief, Joseph Ruggiero. The 28-year-old Tillistrand was admitted to Jacobi Hospital with life-threatening head injuries, made tremendous progress, and spent time in Helen Hayes, a Rockland County Rehabilitation facility. </div>

It was reported that Mrs. Pierpont, a nurse associated with Sound Shore Hospital in New Rochelle, began reviewing Officer Tillistrand's medical charts. Mr. and Mrs. John Pierpont were allegedly escorted out of the hospital and banned from visiting the critically injured Tillistrand at Jacobi Hospital. The Pelham Manor Village Manager, John Pierpont, is not new to controversy. In an article believed to be from October of 1997, the local Town of Pelham newspaper, The Pelham Weekly, headlined an article, "Pierpont: No Comment On Mount Kisco Case." It was reported that Mr. Pierpont had, "no comment on a Westchester County district attorney's inquiry in a Mount Kisco case," noting that, "Pierpont was village manager in Mount Kisco until two years ago." The focus of the District Attorney's investigation was, "whether a crime was committed regarding computer equipment which was unaccounted for when a recent inventory was taken." The article quoted the Mount Kisco police as saying that, "the items [had been] returned." In the Village of Pelham Manor, the Village Manager is the highest public official.</div>

They disseminated a letter admonishing readers of the <em>Yonkers Tribune</em>. The catalyst behind the “seemingly” legal warning stems from concerns over allegations suggesting Yonkers Police Benevolent President Keith Olson engaged in <a class="zem_slink" href="http://en.wikipedia.org/wiki/Misconduct" rel="wikipedia" style="color: #990000;" target="_blank" title="Misconduct">gross misconduct</a>; specifically because he is tasked with the job of protecting the rights of all members regardless of personality conflicts. In his opening statement, Olson took the attitude of blaming everyone for the contentiousness of his conduct. He never directly addressed the seriousness of the allegations of gross misconduct by him and his two collaborators, Yonkers Police 4<sup>th</sup> Precinct Captain John Mueller, and Det. Sgt. Brian Moran of the Yonkers Police Detective Division, who have allegedly engaged in Olson’s “dirty laundry” for years.</div>

Little time transpired before Mueller and Moran were in charge of the Intel Unit (Intelligence Unit) becoming responsible for all confidential police records and personnel files that had and have allegedly made their way to the copy machine. Sources advise that after the files were copied, the files were moved out from their previously uncompromised place of storage over many years, to the<a class="zem_slink" href="http://en.wikipedia.org/wiki/Internal_affairs_%28law_enforcement%29" rel="wikipedia" style="color: #990000;" target="_blank" title="Internal affairs (law enforcement)">Internal Affairs</a> Unit where they now are now reportedly stored since former Yonkers <a class="zem_slink" href="http://en.wikipedia.org/wiki/Police_commissioner" rel="wikipedia" style="color: #990000;" target="_blank" title="Police commissioner">Police Commissioner</a> Edmund Hartnett’s departure approximately two years ago. Insiders have reported that Moran transported most of the files in the rear seat of his police cruiser. One must wonder why. Olson’s open letter to the readers of the <em>Yonkers Tribune</em> demonstrably proclaimed his close bond to his only “two great” former <a class="zem_slink" href="http://en.wikipedia.org/wiki/Housing_Department" rel="wikipedia" style="color: #990000;" target="_blank" title="Housing Department">Housing Department</a> friends. The gist of Olson’s letter is that too much mud has been flung in his direction; his concern is that it cannot be power washed off.</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
The allegations that Yonkers PBA President Keith Olson vehemently denied or purposely avoided are as follows: </div>
<div style="margin-bottom: 10px; margin-top: 10px;">
1) The alleged secret meetings with John Fleming, during which discussions took place targeting then Yonkers Police Commissioner Robert Taggart for the purpose of having one of their choosing succeed Commissioner Taggart. Det. Sgt. Brian Moran is purportedly a distant relative of John Fleming who eventually was appointed a Special Adie to then Mayor Phil Amicone.</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
2) The alleged meetings that took place at which then Yonkers police Commissioner Edmund Hartnett was made aware of the conduct of the “Three Amigos” where he agreed to have a blind eye and sign off on allegedly whatever unauthorized investigations were instigated by the threesome; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
3) Allegedly collecting, gathering, and tampering with official police personnel files and records thereafter to allegedly be used against potential critics and foes as a means of intimidation and retribution; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
4) Allegedly filing false complaints against his own members; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
5) Allegedly impeding internal investigations with frivolous cross complaints; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
6) Allegedly unscrupulous fundraising practices; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
7) <a class="zem_slink" href="http://en.wikipedia.org/wiki/Allegation" rel="wikipedia" style="color: #990000;" target="_blank" title="Allegation">Allegations</a> of missing disbursement funds, not to mention an immodestly paid PBA counsel that cost the membership about $120,000 per annum, plus potential referral business; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
8) Additionally, a whopping stipend of $4,000 a month in favor of Yonkers PBA President Olson; and</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
9) Despite the list of concerns over his conduct and the perception it conjures in people’s minds, Olson dismisses the allegations by not referring to them. He maintains a wall of silence, denial, and lies. His conduct cries out for an investigation and demands assurance that the chain of command is honored without bias, the merits of abiding by the law, and the oath sworn to the Yonkers <a class="zem_slink" href="http://en.wikipedia.org/wiki/Police" rel="wikipedia" style="color: #990000;" target="_blank" title="Police">Police Department</a>.</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
Their collective dismissiveness found them spinning the hair raising allegations, so out of whack with what is alleged to have transpired over many years, that Olson and Mueller find themselves in an uphill battle to maintain their credibility while allegedly attempting to impede a serious internal investigation into the conduct of the Fourth Precinct Captain. Allegedly the Captain, along with Olson’s union assistance may have intentionally misled investigators, prompting Internal Affairs staff to bear the brunt of the investigation. The jury is still out on that one. </div>
<div style="margin-bottom: 10px; margin-top: 10px;">
There were also reports that at a recent PBA meeting, Olson’s board members and a handful of Kool-Aide swilling loyalists gave him a standing ovation after he told his membership that he would not step down; that was after he informed them not to expect a contract until 2015, which will mean that almost a decade will have passed before a new contract will be finalized, likely learning that Yonkers Police Department personnel will only gain zeros in contracts further into their future. One must wonder the rationale of greeting this “news” with a resounding standing ovation and handclap by the Kool-Aide swilling believers. Why else would anyone be clapping for a union leader that has not secured a contract for his members under his former friends Hartnett, and former Yonkers Mayor Phil Amicone, who is also presently embroiled under a cloud of controversy. This has taken place while Olson landed his sister a high paying job at Yonkers City Hall, and Yonkers PBA union members continued to rack up bills he initiated. The final straw to break this camel may be a looming federal lawsuit rumored to be scrutinizing Yonkers’ own Three Musketeers.</div>
<div style="margin-bottom: 10px; margin-top: 10px;">
Keith Olson has shown himself to be arrogant, insular, and using his own words regarding his “two great” friends, believes they all allegedly stand above the protocol and procedures defined for them by the Yonkers Police Department, as well as the law. Olson and his friends stand accused of serious internal and unscrupulous conduct clearly supported by internal emails, memos, and internal letters of complaints needing and demanding oversight of the Yonkers PBA leader by an independent, outside investigative agency, and /or an independent commission. Sometimes only an erudite press / media can ask and reveal the tough issues. In Olson’s case he has not publicly addressed any concerns, except for his steadfast legal advice that is meant to deny and obfuscate everything. What is more evident to all but Olson himself is that he is a hot potato who walks about persona non grata. The reverberating echoes heard in the halls and offices of the Cacace Justice Center and various precincts in Yonkers is that no high ranking official wants to be soiled by Olson and his “two great” friends. </div>
<div style="margin-bottom: 10px; margin-top: 10px;">
Among the many years of august and respected chapters of the Yonkers PBA, there has never been a more propitious time demanding for an independent prosecutor to take a look into the inner working of the Yonkers PBA, specifically under the aegis of Det. Keith Olson, and his rogue supervisor friends that allegedly premeditated and executed some of the allegations he continues to refuse to address. Despite Olson being offered to respond to the allegations divulged, Olson has chosen not to substantiate his conduct and those of his cohorts. Their collective silence diminishes and besmirches the integrity of the men and women in blue. That being the case, how can the administration continue to protect these protagonists knowing that the media is aware of the integrity of the allegations made and others that are still to be revealed?</div>

It should be recognized that the “Blue Truth” series has afforded the Yonkers Police Department the time and opportunity to address the allegations divulged. Were the YPD left to its own internal devices, devoid of political intrusion from within and without Yonkers City Hall, these issues would have been mitigated by now. Instead, every day that passes without remedy tarnishes the YPD, the PBA, and CLSA. That is not right. These concerns must be mitigated and concluded with deference to the law, the oaths sworn by each member of the YPD, in order for function to eclipse the present internal dysfunction.</div>

Apparently, lawyers have formally joined the mounting complaints to The New York State Attorney General's office and The Commission on Judicial Conduct where filings document Drager's unusual impartiality, alarming court orders, blatant conflicts of interest, and a reported disregard of domestic violence.<br />
<a name='more'></a>One hot troubling issue ignored by The Commisson on Judicial Conduct is the court-appointed attorney Margery Greenberg's appearance in the Drager court after contributing to the book, <i>The Good Divorce </i>by lawyer-author- and opposing counsel, Raoul Felder. The eyebrow-raising fact involves the lack of disclosing the conflict of attorney Greenberg before Judge Drager where attorney Felder and Margery represent different parties.<br />

<span class="fullpost" style="display: inline;"><i><b>EXCLUSIVE </b></i><br /><br />According to the wife of New York State's Commission on Judicial Conduct (the "CJC") Chief Counsel, the story involves the lack of sex to the top attorney at the state agency that oversees the ethics of all New York State judges. Robert Tembeckjian's wife, New York Daily News reporter Barbara Ross, also says that the ordeal began near a Pizzeria Uno Restaurant and involved "filthy, black, slippery grease."<br /></span></div>

<span class="fullpost" style="display: inline;">The lawsuit, <i>Barbata Ross and Robert Tembeckjian v. Betty G. Reader Revocable Trust, et al</i>., , was filed on July 5, 2007 in The New York Supreme Court in the Bronx (Index #17038-07). The additional defendants included Emigrant Business Credit Corporation, Uno Restaurant Holdings Corp; Individually and d/b/a Uno Chicago Grill, Pizzeria Uno Corporation, Individually and d/b/a Uno Chicago Grill, and NJC Carting Corporation, Individually and d/b/a Nicholas J. Cicale Carting. The plaintiffs were represented by Edward A. Steinberg of Leav & Steinberg, LLP with offices at 120 Broadway, 18th floor, New York, New York 10271. While the incident occurred in Manhattan, where the Tembeckjians live, the original complaint indicates that one defendant, NJC Carting Corporation, had an address at 2847 Dudley Avenue in the Bronx. According to a source, the case settled in April of 2012.<br /><br />The legal action, according to Ross and Tembeckjian, involved the lack of the defendants to adequately maintain the sidewalk near 391-395 Sixth Avenue in Manhattan. Apparently, Barbara found herself walking in front of the Pizzeria Uno but then suddenly sitting in filthy, black, slippery grease. Barbara described what happened under oath, saying, "I can only liken it to a bagel overstuffed with cream cheese; when you squish it, the stuff comes out on the side. My shoe, my left shoe, the inside of my left shoe, had a ridge of grease, and my clothes were covered with it, my hands were covered with it."<br /><br /><b>Robert Tembeckjian Claimed Lack of Sex From Barbara Ross</b><br /><br />Robert Tembeckjian alleged in the lawsuit that his sex life had been adversely affected on April 6, 2006 when his wife Barbara Ross was, "lawfully traversing over and upon the sidewalk in front of premises 395 Sixth Avenue in the County, City and State of New York." Bob also asserted that his wife "was caused to slip and fall at the aforesaid place as a result of the negligence of defendants…. and without any negligence on her part contributing thereto." Co-plaintiff Robert Tembeckjian further claimed, "….loss of services, companionship, society, and consortium of plaintiff Barbara Ross that would normally flow between a husband and wife." Under oath, Barbara was asked if there had been any disruption in the sexual relationship between her and her husband as a result of the accident. "Yes…. we were monks, for months….until the end of August when I began to feel better…." The good news, for those interested in the top judicial 'ethics' counsel Tembeckjian's sexual happiness, is, according to Barbara, that their sexual relations resumed, "after my shoulder got really better, so probably November of '06."<br /><br /><b>The Tembeckjians Couldn't Take State-Paid Trip to Hawaii</b><br /><br />When asked where she had traveled to since the accident, Barbara mentioned outside Syracuse and San Diego. The San Diego trip, Ms. Ross said, was "vacation slash business, last summer," adding, "[b]ut we lost a trip to Hawaii, because I couldn't deal with -- we lost a -- my kid is still not letting me live it down. A trip to Hawaii, which substantially would have been paid for by my husband's job because it was a business trip. I couldn't, I couldn't do the flight." Ms. Tembeckjian also indicated that there was an "out-of-pocket loss" not only for her family but for friends who where going to accompany her daughter on that trip. It is unknown whether either of the Tembeckjians had been asked if they knew how many state judges and their families had been provided with taxpayer-paid trips to Hawaii.<br /><br /><b>Bob Too Busy Selectively Enforcing Judicial Ethics to Peel Potatoes</b><br /><br />During her April 4, 2008 deposition, Barbara indicated that there were "many, many meals" that she couldn't prepare, so they had, "a lot of eat-out," adding, "If you can peel a potato with one hand, I'll tell you how you do it, you put it between your knees and it takes you 45 minutes to do three pounds of potatoes." Ms. Tembeckjian also said she stopped using her maiden name Boylan, opting for Ross, about two years out of college because, "I worked for another nut named Boylan and I didn't want them to think I was related." After clarifying that Ross had been her prior married name, Barbara indicated that she had been the power of attorney for an Edith Asbury from about April of 2006.</span></div>
