RE: Request to Initiate Judicial Impeachment Proceedings against:
Hon. Francis A. Nicholai and Hon. Anthony A. Scarpino, Jr.
Dear Assemblymember,
I respectfully request that you: (1) begin the process to impeach the Hon. Francis A. Nicholai and the Hon. Anthony A. Scarpino, Jr.,; (2) appoint someone from your office to act as an impeachment liaison; and (3) that your office advise me of your impeachment liaison’s name and contact information so that the exchange of necessary information may begin.
There is evidence, and available testimony, that Judge Nicholai, while administrative judge of the 9th Judicial District, improperly directed judges to rule a certain way. Also, there is clear evidence supporting the fact that Judge Nicholai directed the destruction of hundreds of court case files.
There is undisputed evidence that Judge Scarpino improperly acted to protect an attorney member of his judge’s election transition team who had filed fraudulent papers involving over $100,000.00 in stolen America Red Cross 9/11 donation money- funds that have yet to be repaid. In addition, and on the eve of a Carvel Ice Cream Estate trial, Judge Scarpino accepted over $300,000.00 in “loans” from the very bank he (Judge Scarpino) had appointed over the Carvel estate assets, and where one 19 acre parcel in Westchester, valued at $10 million was sold to the same bank insiders for $2 million.
I have researched the New York State Commission on Judicial Conduct (the “CJC”) for many years and have found that entity to be completely corrupt. The CJC acts to cover-up certain judicial misconduct and/or retaliate against other judges based simply on the whim of connected insiders. I have personally introduced to federal prosecutors New York judges who have either been themselves wrongly targeted or who have been afraid to speak up against corruption out of fear of New York styled retaliation. The CJC is corrupt, and it is up to you, as an elected assemblymember, to take immediate action. (Please see, www.Ethicsgate.com)
I recently confirmed the fact that the CJC has engaged in the illegal wiretapping of certain judges, and I will share that information with your office’s appointed liaison; Governor Cuomo was advised in February. I believe your office should be in touch with the federal prosecutor involved in the case where more than 1.5 million pieces of evidence, currently under seal, support the widespread practice of illegal wiretapping in and about New York’s legal system.

The push for Impeachment proceedings follows the recent confirmation that the statewide judicial ethics committee, the Commission on Judicial Conduct (the "CJC"), was itself corrupt. The chief counsel of the CJC, Robert Tembeckjian, and his former deputy, Alan W. Friedberg, have become icons of the current statewide ethics scandal in New York-- sometimes referred to as Tammany Hall 2--- a systemic collection of whitewashing and cover-up. Tembeckjian and Friedberg testified in Albany at the New York State Senate Judiciary hearings on June 8, 2009 and stunned those who read the written transcript, or who had viewed the hearing videos. In New York State, "articles of impeachment" begin in the State Assembly and require a simple majority vote "to impeach" by members of the New York State Assembly. The impeachment process then moves to the Impeachment Court and the New York State Senate where a conviction, and removal, requires a two-thirds majority vote after a trial. The most famous trial by the New York Impeachment Court involved Governor "Plain Bill" William Sulzer in 1913. His troubled short reign as a Tammany Hall backed governor lasted less than 10 months. Sulzer is the only NY governor to have ever been impeached.
The "Court for the Trial of Impeachments and the Correction of Errors" was established by the New York State Constitution in 1777. The body considered improper acts of a political, moral or ethical nature, along "other subjective points of view." In 1846, the "Court for the Correction of Errors" was abolished as its jurisdiction was transferred to the New York State Court of Appeals. The existing New York "Court for the Trial of Impeachments" has also been called the "Impeachment Court" and the "High Court of Impeachment." In New York, Article 6, Section 24, of the New York State Constitution applies:
Court for trial of impeachments; judgment
24. The assembly shall have the power of impeachment by a vote of a majority of all the members elected thereto. The court for the trial of impeachments shall be composed of the president of the senate, the senators, or the major part of them, and the judges of the court of appeals, or the major part of them. On the trial of an impeachment against the governor or lieutenant-governor, neither the lieutenant-governor nor the temporary president of the senate shall act as a member of the court. No judicial officer shall exercise his or her office after articles of impeachment against him or her shall been preferred to the senate, until he or she shall have been acquitted. Before the trial of an impeachment, the members of the court shall take an oath or affirmation truly and impartially to try the impeachment according to the evidence, and no person shall be convicted without the concurrence of two-thirds of the members present. Judgment in cases of impeachment shall not extend further than removal from office, or removal from office and disqualification to hold and enjoy any public office of honor, trust, or profit under this state; but the party impeached shall be liable to indictment and punishment according to law. I greatly applaud all your efforts in so many ways.
ReplyDeleteAs a wiretap victim,as well as a victim also of many other criminal activities by the NY Court system in their attempt to terrorize myself and my family, I wish you success and hand you my support.
I too am in the process of exposing them and realize that they are perplexed as to how to handle my case and protect OCA from indictments!
However my situation is handled or covered up, the facts will make their way to thousands..guaranteed.

ReplyDeleteHow can I get involved I am also a victim of Judge in the Westchester County Supreme court. I have court documents and court transcripts as evidence. I am fighting my case alone for last 6 years.
